Petitioner Donald W. Duncan petitions for review of the initial decision of the Merit Systems Protection Board (the "Board"), dismissing Duncans appeal for lack of jurisdiction. Duncan v. United States Postal Serv., No. DE-0752-97-0631-I-1 (M.S.P.B. Sept. 30, 1997). The initial decision became the final decision of the Board when the Board denied Duncans petition for review. Duncan v. United States Postal Serv., (M.S.P.B. Jan. 14, 1998). Because while he was on administrative leave Mr. Duncans salary was paid and because he was lawfully placed on administrative leave, the Boards decision to dismiss Mr. Duncans constructive suspension claim for lack of jurisdiction is affirmed.
